Aurora Shooting Suspect Appears in Court, Changes Look and Behavior

ARAPAHOE COUNTY, Colo.- Aurora shooting suspect James Holmes was back in court Thursday.

He's facing 142 counts, including murder and attempted murder, and prosecutors just announced they're giving up one small battle involved in the case to keep it moving forward.

James Holmes is accused of killing 12 people and wounding 58 others during a midnight showing of the new Batman movie at an Aurora movie theater on July 20.

In a hearing Thursday morning, prosecutors said they're giving up their fight to see a notebook sent to a psychiatrist by Holmes before the shooting.

Deputy District Attorney Rich Orman says If mental health becomes an issue, Holmes will have to waive the doctor-patient privilege and prosecutors would then gain access to the notebook.

Holmes appeared more animated that usual during Thursday's hearing.

His orange hair was gone, replaced with short brown hair.

He smiled and glanced around, looking at his lawyers and reporters.
