Make My Day Law Keeps Orchard Mesa Man out of Court

No Charges Will Be Filed in Fatal Shooting

Mesa County - The Mesa County District Attorney's Office will not file charges in a shooting that occurred at an Orchard Mesa home because it meets the criteria of Colorado's Make My Day Law.

In a letter to the Sheriff's Office from the District Attorney's Office, Chief Deputy District Attorney Mark Hand wrote, "We have declined to file charges because based on the evidence compiled during the course of this investigation the DA finds it difficult, if not impossible, to overcome the immunity from prosecution claim for use of deadly force against an intruder."

Officials say around 10:00 AM November 25th, 2011, dispatch received a 911 call from a resident located at 197 Indiana Street stating he had shot a burglar who was attempting to enter his home. Deputies responded to the scene and found the body of Jesus Sanchez near the front door of his residence.

You liberals have no brains. That is what the 2nd ammendment gave us and the conservatives that were in this state before it got over run by liberals allowed us to do. Keep the criminals from harming our families. I stopped watching this liberal channel because of this type of bias. Power to the gun owners who wish to untilize their rights.

You mean, how dare they do their jobs by fully investigating a potential crime just because the court of uninformed public opinion has already found the shooter not guilty?

The fact that they would even try to "overcome imunity to prosecution" in a case like this should give us all pause for concern. Aren't there enough actual crimes they should be prosecuting in stead of hunting a loophole so they can prosecute somebody defending their home and family?
