Kindergartner off the Hook for Bringing Toy Gun to School

A Grand Junction kindergartner will not be expelled for bringing a toy gun to class. That's because of a new state law.

The Nisley Elementary student brought the toy gun to show his friends. A teacher found it in his backpack on Tuesday.

School officials say state law previously would have required the student to be expelled for having the toy, but lawmakers changed the law back in 2009. Officials say it gives them more wiggle room to handle each situation on a case-by-case basis.

Lawmakers changed the state's zero tolerance law after a 17-year-old drill team commander was suspended from an Aurora school for having practice rifles in her car parked in the school parking lot.
