Magistrate Judge Recommends Theater Shooting Lawsuit Dismissals

DENVER A U.S. judge magistrate is recommending the dismissal of several lawsuits filed by people affected by the Aurora theater shooting.

Magistrate judge Michael Hegerty made the recommendation in seven different suits filed against Cinemark.

Plaintiffs argue Cinemark failed to prevent the attack while Cinemark claims no one could have foreseen it.

The judge says plaintiffs must pursue their claims under the Colorado Premises Liability Act, which covers injuries on someone elses property blocking negligence and wrongful death claims.
