First-Degree Murder Conviction Reversed for Local Man

GRAND JUNCTION, Colo.- A local man who was sentenced in 2008 will get a new trial.

On Thursday the Colorado Court of Appeals reversed in part first-degree murder charges for Brandon Moore.

Moore was found guilty of first-degree murder and child abuse resulting in death to his stepson, Logan Acord.

The family says after everything that's happened in the past five years, they are completely shocked with the reversal of the conviction. "It was a word, one word, and I think it was 'knowingly' but I'm not sure. The judge defined 'knowingly' for the jury and the defense objected to it, or something, and he gets off on it? It's not about whether he killed the baby or not it's about a word," said Pam and Mitch Acord, grandparents of the victim.

Other family members of the victim agree, "Our family's been through more than enough. There's not a day in the last five years that we haven't suffered and thought of this horrible thing," said Ruth Acord, the great grandmother of Logan Acord.

The family says they will without a doubt take this to trial again, to fight for justice for Logan Acord.

The defense argued that Moore panicked and began hitting Acord in an attempt to wake him after the boy slipped and hit his head on the bathtub.

A date for a new trial is unknown at this time.

well if you were paying attention to what you were reading you would know that i wasnt defending Moore just his family. I hope that nothing ever happends with your children and you get blamed as the parent. no compasion. The justice system failed Moore and thats why this is all happening and people are scared to admit that and fear can be a devil all in itself.Im done said my opinion and some times you cant argue with stupid

Really Jaquelle he murdered a a 2 Year old child he deserves nothing his family is as evil as he is after all the apple never falls far from the tree really how can you defend such a monster????? Any man or woman that abuses a child should have done to them what they did to that child

You know its sad that everyone is only concerned about the acord family, i feel bad for moores family. theyve been through all of this as well. I personaly dont think a new trial is worth my tax money. Theres been multiple child abuse cases in the surrounding counties, and moore with the 48 years is still double what the other men got.

Apparently this is all over the Judge defining the word 'Knowingly' to the jury. Which apparently is "unconstitutional" if you are being tried by a panel of your peers. SOMEBODY PLEASE EXPLAIN TO ME HOW THAT IS AGAINST YOUR CONSTITUTIONAL RIGHT!
