Murder Charges Dismissed for Babysitter in Infant Death Case

Montrose - A Montrose woman originally charged with first degree murder after a baby died in her care is no longer facing criminal prosecution. Prosecutors have dismissed the charges against 32-year-old Maria Espinoza-Zavala.

According to Defense Attorney Harvey Palefsky, doctors who performed the infant's autopsy could not confirm the brain injury occurred while she was in the custody of Espinoza-Zavala.

Also, Palefsy says, after reviewing the five-hour taped questioning, it was determined that Espinoza-Zavala made no confession.

Back in October, 4-month-old Angel Nieto was in Espinosa-Zavala's care in October when the baby was found unconscious and rushed to Montrose Memorial Hospital. The infant died a few days later.

Authorities say the investigation is still ongoing.
